A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without legal authority.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.

The situation originates in a erroneous deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his return to the United States to face alien smuggling charges, he was held in federal custody.

In her order, the court pointed out that the government lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
